Welcome to Supa.menu ("Supa," "we," "us," or "our"). By accessing or using our website at https://supa.menu and any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

1. Description of Service

Supa is a digital menu platform that enables businesses to create and manage online menus. Users upload photos of their physical menus, and our AI-powered system extracts menu items, prices, and other details to generate a public, multilingual digital menu.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using Supa, you represent and warrant that you meet these requirements.

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate and complete information during registration
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload content that infringes on intellectual property rights of others
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers
• Use automated means to access the Service without our permission
• Upload malicious content, viruses, or harmful code

5. Content Ownership

• Your Content: You retain ownership of all content you upload to Supa, including menu photos, item names, descriptions, and prices. By uploading content, you grant us a non-exclusive, worldwide license to process, store, and display your content as necessary to provide the Service.
• Our Content: The Service, including its design, features, and technology, is owned by Supa and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

6. AI Processing

Our Service uses artificial intelligence to extract menu data from uploaded images. While we strive for accuracy, AI-generated results may contain errors. You are responsible for reviewing and correcting any extracted data before publishing your digital menu.

7. Subscription and Payments

• Some features of the Service require a paid subscription
• Subscription fees are billed in advance on a recurring basis
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
• We reserve the right to change our pricing with reasonable notice
• Refunds are handled in accordance with applicable consumer protection laws

8. Free Trial

We may offer a free trial period. At the end of the trial, you will need to subscribe to a paid plan to continue using premium features. We will notify you before the trial expires.

9. Termination

We may suspend or terminate your account if you violate these Terms or engage in conduct that we determine is harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately.

10. Service Availability

• The Service is provided on an "as available" basis. We do not guarantee uninterrupted, timely, or error-free operation of the Service.
• The Service may be temporarily unavailable due to maintenance, updates, software bugs, server failures, or circumstances beyond our control.
• We are not liable for any losses, damages, or inconvenience caused by downtime, service interruptions, or errors in the Service, including but not limited to your public menu being temporarily inaccessible to your customers.
• We will make reasonable efforts to restore the Service promptly but make no guarantees regarding resolution times.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• Supa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, customers, business opportunities, or goodwill, whether incurred directly or indirectly
• Supa shall not be liable for any loss of data, including menu content, uploaded images, or extracted menu data
• Supa shall not be liable for any damages arising from bugs, errors, or defects in the Service, including incorrect display of menu items, prices, translations, or allergen information
• Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to Supa in the twelve (12) months preceding the claim
• These limitations apply regardless of the theory of liability (contract, tort, strict liability, or otherwise), even if we have been advised of the possibility of such damages

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. Specifically, we do not warrant that:

• The Service will be available at all times or free from errors, bugs, or interruptions
• Menu data extracted by AI will be accurate, complete, or free of errors
• Translations will be linguistically accurate or culturally appropriate
• The Service will meet your specific business requirements
• Any defects in the Service will be corrected within a particular timeframe

13. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms shall be resolved in accordance with applicable law and jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Effective Date." Your continued use of the Service after changes constitutes acceptance of the updated Terms.
